เงื่อนไขและข้อกำหนดการบริการTerms of Service

เอกสารนี้คือข้อตกลงทางกฎหมายระหว่างคุณ ("ผู้ใช้") กับ บริษัท ฟิช คอนเนคท์ จำกัด ("FishConnect", "เรา") เกี่ยวกับการใช้แอปพลิเคชัน FishConnect เว็บไซต์ fishconnect.co และบริการที่เกี่ยวข้อง (รวมเรียกว่า "บริการ") โดยการสมัครใช้งานหรือใช้บริการ คุณยอมรับเงื่อนไขนี้ This document is a legal agreement between you ("User") and FishConnect Co., Ltd. ("FishConnect", "we", "us") regarding the FishConnect mobile app, the website at fishconnect.co, and related services (collectively, the "Service"). By signing up or using the Service, you accept these Terms.

1. การยอมรับเงื่อนไข1. Acceptance

การสร้างบัญชีหรือใช้บริการ ถือว่าคุณยืนยันว่าคุณ (ก) มีอายุไม่ต่ำกว่า 18 ปี หรือได้รับความยินยอมจากผู้ปกครอง (ข) มีอำนาจตามกฎหมายในการทำสัญญานี้ และ (ค) อ่านและยอมรับเงื่อนไขทั้งหมด รวมถึง นโยบายความเป็นส่วนตัว และ นโยบายคุกกี้ By creating an account or using the Service, you confirm that (a) you are at least 18 years old or have parental consent, (b) you have legal capacity to enter this agreement, and (c) you have read and accepted these Terms together with our Privacy Policy and Cookie Policy.

2. บริการของเรา2. The Service

FishConnect ให้บริการบันทึกข้อมูลปลา (Pedigree), การจัดการสินทรัพย์ดิจิทัล (My Fish), ตลาดซื้อขายปลาออนไลน์ (Marketplace) และคอมมิวนิตี้ผู้เลี้ยงปลา (Community) เราอาจปรับปรุง เพิ่มเติม หรือยกเลิกฟีเจอร์ใดๆ โดยแจ้งให้ทราบล่วงหน้าตามสมควร FishConnect provides fish records (Pedigree), digital asset management (My Fish), an online marketplace, and a community network. We may improve, add, or discontinue features with reasonable notice.

3. บัญชีผู้ใช้3. Accounts

• คุณต้องให้ข้อมูลที่ถูกต้อง ครบถ้วน และเป็นปัจจุบันYou must provide accurate, complete, and up-to-date information.
• คุณรับผิดชอบต่อความปลอดภัยของรหัสผ่านและกิจกรรมในบัญชีของคุณYou are responsible for the security of your password and all activity on your account.
• หนึ่งคนสามารถมีได้หนึ่งบัญชีต่อบุคคล/นิติบุคคลOne account per person or entity.
• เราอาจระงับหรือลบบัญชีที่ฝ่าฝืนเงื่อนไขWe may suspend or terminate accounts that violate these Terms.

4. เนื้อหาของผู้ใช้4. User Content

คุณยังคงเป็นเจ้าของเนื้อหาที่อัปโหลด (รูปปลา, ประวัติ, โพสต์, ข้อความ) แต่ให้สิทธิ์เราในการใช้ จัดเก็บ ทำสำเนา และแสดงผลเพื่อให้บริการ คุณรับประกันว่าเนื้อหาที่คุณอัปโหลดไม่ละเมิดสิทธิ์ของผู้อื่น You retain ownership of content you upload (fish photos, records, posts, messages) but grant us a license to host, store, copy, and display it to operate the Service. You warrant your content does not infringe others' rights.

5. กฎของ Marketplace5. Marketplace Rules

• ผู้ขายต้องระบุข้อมูลปลาที่ถูกต้อง ครบถ้วน — รวมถึงสายพันธุ์ อายุ สุขภาพSellers must list accurate, complete information — including breed, age, and health.
• ห้ามขายสัตว์คุ้มครองหรือสัตว์ที่ผิดกฎหมายListing protected or illegal species is prohibited.
• การโอนสิทธิ์ปลาต้องผ่านระบบในแอปเท่านั้นOwnership transfers must go through the in-app system.
• ความรับผิดในการขนส่งและการรับประกันปลาเป็นของผู้ขายและผู้ซื้อ FishConnect ไม่เป็นคู่สัญญาในการซื้อขายShipping liability and fish warranties are between buyer and seller. FishConnect is not a party to the transaction.

6. ค่าธรรมเนียมและการชำระเงิน6. Fees & Payments

การใช้งานทั่วไปฟรี Marketplace อาจคิดค่าธรรมเนียมเล็กน้อยจากการขายสำเร็จ (เช่น 3-5% ของราคาขาย) เราจะแจ้งอัตราค่าธรรมเนียมล่วงหน้าก่อนการเปลี่ยนแปลงใดๆ General use is free. The Marketplace may charge a small fee on completed sales (e.g., 3–5% of the sale price). We will provide advance notice before changing any fee schedule.

7. ข้อห้าม7. Prohibited Conduct

• ปลอมแปลงประวัติปลา หรือสายพันธุ์Falsifying fish records or pedigree.
• แอบอ้างเป็นบุคคลอื่นหรือแบรนด์อื่นImpersonating other persons or brands.
• โพสต์เนื้อหาที่ผิดกฎหมาย ลามก หรือคุกคามPosting illegal, obscene, or harassing content.
• พยายามแฮก สแปม หรือรบกวนการทำงานของระบบHacking, spamming, or interfering with the system.

8. ทรัพย์สินทางปัญญา8. Intellectual Property

โลโก้ ชื่อ "FishConnect" ดีไซน์ของแอปและเว็บไซต์ เป็นทรัพย์สินทางปัญญาของบริษัท ฟิช คอนเนคท์ จำกัด การใช้งานนอกเหนือจากที่อนุญาตต้องได้รับความยินยอมเป็นลายลักษณ์อักษร The logo, "FishConnect" name, and the design of our app and website are intellectual property of FishConnect Co., Ltd. Use beyond what is permitted requires written consent.

9. ข้อจำกัดความรับผิด9. Disclaimers & Liability

บริการให้ตามสภาพ ("AS IS") เราไม่รับประกันว่าจะปราศจากข้อผิดพลาดหรือใช้งานได้ตลอดเวลา ภายในขอบเขตที่กฎหมายอนุญาต ความรับผิดของเราจำกัดไม่เกินค่าธรรมเนียมที่คุณจ่ายในรอบ 12 เดือนที่ผ่านมา The Service is provided "AS IS" without warranty that it will be error-free or available at all times. To the extent permitted by law, our liability is capped at the fees you paid in the prior 12 months.

10. การยุติบริการ10. Termination

คุณสามารถปิดบัญชีได้ตลอดเวลาผ่านการตั้งค่า เราอาจระงับหรือยุติการให้บริการกับบัญชีที่ละเมิดเงื่อนไข ข้อมูลปลาที่โอนไปแล้วยังคงอยู่กับเจ้าของใหม่ เพื่อให้ประวัติย้อนหลังไม่ขาดสาย You may close your account anytime through Settings. We may suspend or terminate accounts that violate these Terms. Records that have been transferred remain with the new owner so historical lineage stays intact.

11. กฎหมายที่ใช้บังคับ11. Governing Law

เงื่อนไขนี้อยู่ภายใต้กฎหมายของราชอาณาจักรไทย ข้อพิพาทใดๆ จะอยู่ในอำนาจของศาลที่มีเขตอำนาจในประเทศไทย These Terms are governed by the laws of the Kingdom of Thailand. Disputes will be subject to the jurisdiction of competent courts in Thailand.

12. การเปลี่ยนแปลงเงื่อนไข12. Changes

เราอาจแก้ไขเงื่อนไขนี้เป็นระยะ การเปลี่ยนแปลงสำคัญจะแจ้งล่วงหน้าทางอีเมลหรือผ่านแอป การใช้บริการต่อไปหลังการเปลี่ยนแปลงถือเป็นการยอมรับ We may revise these Terms periodically. Material changes will be communicated by email or in-app. Continued use after changes constitutes acceptance.
